Terms of Service – TrivaCloud

These Terms of Service (“Terms”) govern your access to and use of the hosting, domain, cloud, billing, and
related services provided by TrivaCloud (“we”, “us”, or “our”).
By ordering or using our Services, you agree to be bound by these Terms.


1. Definitions

  • “Client” refers to any customer purchasing or using TrivaCloud services.
  • “Services” include cloud hosting, VPS, shared hosting, domain registration, billing, and any related solutions.
  • “Account” means your registered client profile used to manage services.
  • “Content” means all data, files, websites, software, or information uploaded or hosted by the client.

2. Eligibility

By using our Services, you represent that you are at least 18 years old and legally able to enter into a binding agreement.


3. Account Registration

To use the Services, you must create an account and provide accurate information. You agree to:

  • Maintain updated account details.
  • Keep your login credentials confidential.
  • Be fully responsible for all activities under your account.

4. Service Activation & Provisioning

Services will be activated once payment is confirmed. Certain services (e.g., domains) may require additional verification.

TrivaCloud reserves the right to delay or refuse activation if fraud or high-risk activity is suspected.


5. Acceptable Use Policy (AUP)

You agree NOT to use the Services for any of the following:

5.1 Prohibited Content

  • Phishing, malware, spam, or fraudulent websites
  • Hate speech, illegal content, extremist propaganda
  • Pornography involving minors or illegal adult content
  • Unauthorized copyright material
  • Gambling (where prohibited)

5.2 Prohibited Activities

  • DDoS attacks or botnet operations
  • Distributing viruses, exploits, or malicious tools
  • Resource abuse or attempting to bypass system limitations
  • Hosting proxy/VPN for illegal purposes
  • Email spamming or mass emailing without permission

Violation of AUP may result in immediate suspension or termination.


6. Payments & Billing

6.1 Billing Cycle

  • Invoices are generated before your due date.
  • You must pay on or before the due date to avoid suspension.

6.2 Late Payments

  • Services may be automatically suspended if payment is overdue.
  • Reactivation fees may apply for restoring suspended services.

6.3 Non-Refundable Fees

The following are strictly non-refundable:

  • Domain registration or renewal
  • Server setup fees
  • Any third-party licensed software

6.4 Refund Eligibility

Refunds (if granted) are at our discretion and only for unused prorated hosting services.


7. Service Suspension & Termination

7.1 Grounds for Suspension

We may suspend your service for:

  • Late payment
  • AUP violations
  • Security threats or suspicious activity
  • Government requests or legal orders

7.2 Termination

Your service may be terminated permanently for:

  • Repeated AUP violations
  • Severe abuse activities
  • Unpaid invoices after the grace period

8. Data Backup & Responsibility

While TrivaCloud implements backup systems, the Client is fully responsible for maintaining their own backups.
We are not liable for data loss, corruption, or accidental deletions unless explicitly stated in your plan.


9. Uptime Guarantee

Shared hosting and VPS services come with a service-level uptime target. However, unexpected downtime,
maintenance, or third-party issues may occur.

Uptime guarantees do not apply to:

  • Client-side errors
  • Misconfigurations by the client
  • DDoS attacks or external network failures

10. Domains & DNS

10.1 Domain Registration

Domain registrations are processed through third-party registrars. Once registered, domains cannot be refunded.

10.2 WHOIS Information

You are responsible for ensuring accurate WHOIS data. False WHOIS info may result in suspension by the registry.

10.3 DNS & Propagation

DNS changes typically propagate within minutes but may take up to 48 hours.


11. Third-Party Services

Some features rely on third-party providers (e.g., Cloudflare, DirectAdmin, cPanel, domain registrars, payment gateways).

TrivaCloud is not responsible for downtime or failure caused by third-party services.


12. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.
  • We are not responsible for client-side errors, misconfigurations, or security breaches caused by the client.
  • Our total liability will not exceed the amount paid for the service during the last 30 days.

13. Indemnification

You agree to indemnify and hold TrivaCloud harmless from any claims, damages, or losses related to your usage
of the Services, including violations of law or these Terms.


14. Security

We implement various security measures, but no system is 100% secure. Clients are responsible for:

  • Using strong passwords
  • Updating CMS/plugins
  • Securing their own applications and data

15. Changes to the Terms

We may modify these Terms at any time. Continued use of the Services after changes are posted constitutes
acceptance of the updated Terms.
